Last year, Mr Justice Wall ordered that force could be used on a woman detained in a mental hospital, to impose an induced labour or a Caesarean. The Official Solicitor argued for the use of force on his own client under the Mental Health Act 1983. The judge’s reasoning for this barbarism was that a Caesarean was treatment for the woman’s mental disorder: a decision derided by many legal critics. This is the man who ordered an anorexic teenager to be locked up a few days ago.
What is particularly sinister is the anonymity afforded by the court to the hospital and the doctors in this latest case, as in so many others. If state hospitals want to kill or otherwise abuse their patients, they should be forced to bring their cases into open court, in the Queen’s Bench Division. The patient should have independent, civil liberties lawyers acting for him or her: not the Official Solicitor. Last year, we heard that children as young as 12 at a school in Scotland were getting free condoms from the school medical centre; the Family Planning Association had published a workbook for primary schools that included information about masturbation and oral sex; the Health Education Authority had to pulp 12,000 copies of its Pocket Guide to Sex for teenagers because it was deemed “distasteful and smutty”, and a nurse at a Leeds primary school had answered questions about oral sex and “Mars Bar parties”.
The nurse was later vindicated by a local authority report but not before John Patten, then Secretary of State for Education, had expressed his outrage and disgust: “I am incensed to think that very young children could be exposed … to things which at a particular age they should not even be beginning to understand, let alone understand.”Mr Patten probably felt he was speaking on behalf of most British parents – but was he? Do parents really believe their young ones can or should be kept in blissful ignorance until their teens or are they more realistic? And if primary schools are to play a part, what should they be teaching – when and how?While secondary schools are legally bound to provide sex education, in the primary sector it remains in the hands of school governors.

If they choose to provide sex education over and above what appears in the compulsory science curriculum, then the school must have a policy stating when, where and how it will be taught. Michael Ward, managing director, picks up a pounds 527,000 pay-off, has options showing a surplus of pounds 120,000 and has been granted a new contract with UniChem at his old rate of pounds 200,000 a year, plus a bonus of pounds 177,000.Martyn Hardy, who is also being kept on within UniChem at his former salary of pounds 100,000 a year, collects pounds 241,500 and has options showing a profit of pounds 68,000.Jonathan Fellows, finance director, has agreed a consultancy with UniChem worth pounds 77,000 a year, while Mr Turner has agreed a similar two-year deal worth pounds 168,000 in the first year.. In addition, Lloyds has agreed to pay pounds 1.2m into a pension scheme to buy out his accrued rights and he could pick up pounds 201,000 profits on options in which he has an interest.Mr Lloyd has also been given an option to buy two Lloyds subsidiaries, GJ Maley and Savory & Moore (Jersey), at their current market price, subject to no competing offer topping his price. Panmure Gordon, the stockbroker, has been fined pounds 50,000 plus costs of pounds 10,000 and severely reprimanded by the Securities and Futures Authority (SFA) over a pounds 3m fraud by a former employee.The SFA yesterday criticised Panmure for “inadequate protection of clients’ assets, for failure in its control of its internal affairs and for failing to adequately train and properly supervise its staff.”The City regulator also banned the fraudster concerned, Jeremy Gray, from further investment business and ordered him to pay costs of pounds 4,000. A spokeswoman said that Peter Sanguinetti, the director for corporate affairs, would continue in his role and report to Mr Whybrew.Mr Hampton, who is highly regarded by City analysts, receives a pounds 70,000 golden hello in addition to his pounds 295,000 salary. The up-front payment is to compensate him for loss of share options at British Steel, where his package of pay and bonus was almost pounds 290,000.Mr Whybrew’s salary is pounds 275,000 and, as with Mr Hampton and other British Gas directors, he receives neither bonuses nor share options.. At the same time, he will be in charge of the gas supply business at a time when the domestic market is being opened up to competition from rivals, including offshore companies and electricity firms.British Gas also confirmed that John Whybrew would join the board from Shell, in the newly created role of director for strategic planning and corporate affairs.

British Gas concluded a round of sweeping boardroom changes with the appointment as group finance director of Philip Hampton, the 42-year-old finance director of British Steel. Mr Hampton succeeds Roy Gardner, who has taken on a much wider brief and is increasingly regarded as the eventual replacement for the chief executive, Cedric Brown, now seen as the last of the old guard.Mr Gardner, who joined from GEC in late 1994, takes on the formidable responsibility of renegotiating long-term contracts with North Sea producers, which are forcing the company to buy much more gas than it can sell, often at prices above those available in the market today. The payout followed Scantronic’s takeover last November by Menvier Swain.Together with the cost of closing Scantronics’s headquarters, the pay- off has caused a pounds 1m exceptional charge that will wipe out any profits made in the second half to April.Mr Brookes had been on a five-year contract until Scantronic’s board negotiated it down to three years shortly before the pounds 10.5m takeover.He was on a salary of pounds 210,000 plus pension contributions at 15 per cent of salary, at a time when Scantronic had fallen heavily into loss.Menvier said it will also be writing down the value of Scantronic stock on its balance sheet by pounds 4m in the second half.Mr Brookes’ payout was not the only one to hit Menvier Swain.Just before Christmas the firm also paid a sum believed to be pounds 250,000 to settle a lawsuit with the former finance director Ray Dias.Mr Dias left the company after pressure from institutions when Scantronic hit trading problems amid mounting debt in July 1994.. Ian Martin, who left the company to become chairman of Unigate, was paid pounds 557,458.David Nash was paid pounds 790,000, the company confirmed yesterday, when he lost out to John McGrath in the battle for the position of chief executive.At the other end of the pay scale, the company last month paid pounds 106,000 in compenstion to 900 of its Burger King staff who were told to clock off on unpaid breaks whenever the outlets were quiet.Meanwhile, Scantronic, the security alarms firm, revealed yesterday a pounds 780,000 payout to former chief executive Chris Brookes hit profits.
